Delhi: HC orders closure of banquet halls

February 17, 2006 18:59 IST

The Delhi High Court Friday ordered the Municipal Corporation of Delhi to close down all banquet halls functioning in the capital's residential areas. "Running of banquet halls are a perennial source of nuisance for residents, besides causing traffic congestion in the city, and they should go forthwith," a Division Bench of Justice Vijender Jain and Justice Rekha Sharma ruled.

The court clarified that Thursday's Supreme Court order on dismantling commercial structures in residential areas would apply to banquet halls as well.

The directions were given while dealing with a public interest litigation complaining about the functioning of commercial farmhouses in the city. The Bench observed that it was not only farmhouses but scores of banquet halls which have surfaced in residential areas illegally, causing severe hardships to the general public.
Hence, it asked the MCD to take immediate steps to close down such halls. Earlier, the court reiterated that no farmhouses would be allowed to organise commercial activities if the approach road was less that 60 feet wide. Justice Jain refused to buy the argument of the MCD and some farmhouse-owners that the 60-feet width should be computed between two buildings.
